What is the Magistrates' Court?

The Magistrates' Court is a key part of the criminal justice system in England and Wales, handling the majority of criminal cases. These courts deal with less serious offences, known as summary offences, such as minor assaults, motoring offences, and public order offences. Additionally, they handle either-way offences, which can be heard either in the Magistrates' Court or the Crown Court, depending on the severity of the case. More serious offences, such as robbery or murder, are transferred to the Crown Court after an initial hearing in the Magistrates' Court.

The Magistrates' Court also has the authority to issue penalties, including fines, community orders, and up to 12 months' imprisonment for a single offence, or up to 6 months for more than one offence.

Legal Aid and Private Representation

For those who are not eligible for legal aid, Allen Hoole offers competitive private representation. We provide clear, transparent pricing to ensure that you receive expert legal support without unexpected costs.

Free Representation for Youths

In the Magistrates' Court, youths (individuals aged 10 to 17) are almost always automatically eligible for legal aid, meaning their representation is free of charge. For these young people, facing criminal charges can be particularly overwhelming, and it is essential that they receive specialised legal support. Our team at Allen Hoole has significant experience in representing youths and understands the importance of ensuring that their rights are fully protected throughout the court process.

Why Legal Representation is Important

Having skilled legal representation in the Magistrates' Court is essential. While these courts deal with less severe offences than the Crown Court, the consequences of a conviction can still be significant, affecting your employment, driving licence, or even leading to a prison sentence.

A dedicated legal team can help by:

  • Advising on your plea
  • Building a strong defence strategy
  • Challenging evidence
  • Ensuring your case is handled fairly and efficiently
