Fixed Fees for Motoring Offences

Fixed Fees or Hourly Rate

We can either give you a fixed price or charge you by the hour.

Fixed Price

We may be able to agree a fixed price with you at the start of the case.  That price depends upon whether you plead guilty or not guilty, any particular complexities and whether the case needs additional hearings.

The price guide below sets out typical fees for single hearings unless otherwise stated. If further hearings are necessary to resolve your case, then additional fees may be payable, but we can advise you on the likelihood of this. These fees are exclusive of VAT (charged at 20%) and any disbursements such as expert reports or travel expenses.

*Local courts include Bristol Magistrates’ Court, Bath Magistrates’ Court and Cheltenham Magistrates’ Court.

Our fixed fee single hearing costs cover the following:

  • Obtaining material: We will obtain the evidence from the Police or Crown Prosecution Service.
  • Preparation: Reviewing evidence and preparing for court.
  • Initial Consultation: Discussing your case, taking your instructions, advising on the legal process, the strength of the evidence, your plea and possible outcomes.
  • Representation: Attending a single court hearing and representing you.
  • Advice on Sentencing: Providing guidance on potential outcomes and sentencing.

Our fixed fee special reasons/exceptional hardship argument costs cover the following:

  • Obtaining material: We will obtain the evidence from the Police or Crown Prosecution Service.
  • Preparation: Reviewing evidence and preparing for court.
  • Initial Consultation: Discussing your case, taking your instructions, advising on the legal process, the strength of the evidence and your prospects of success in keeping your licence through the exceptional hardship or special reasons hearing.
  • Representation: Attending a single court hearing and representing you.
  • Advice on Sentencing: Providing guidance on potential outcomes and sentencing.

Our fixed fee for a conference without hearing includes:

  • Preparation: Reviewing the prosecution material and your documents/instructions.
  • Meeting in person, over the phone or via video-conference: Advising on procedure, strength of evidence, plea and possible sentencing based on a one-hour conference.

Our fixed fee for a trial (half day) includes:

  • Obtaining material: We will obtain the necessary prosecution material from the Police or Crown Prosecution Service.
  • Consultation: Discussing your case, taking your instructions, advising on the legal process, the strength of the evidence and possible outcomes.
  • Preparation: Preparation for trial.
  • Representation: Attending court for a half-day trial (4 hours).

Our fixed fee for a trial (full day) includes:

  • Obtaining material: We will obtain the necessary prosecution material from the Police or Crown Prosecution Service.
  • Consultation: Discussing your case, taking your instructions, advising on the legal process, the strength of the evidence and possible outcomes.
  • Preparation: Preparation for trial.
  • Representation: Attending court for a half-day trial (8 hours).

Additional Costs

Please note that our fixed fees do not include:

  • Disbursements: Such as expert witness fees, medical reports, or interpreter costs.
  • Travel Expenses: For hearings outside our local court areas, additional travel costs may apply.
  • Mileage: Mileage is charged at a rate of 45p per mile.
  • Additional Hearings: If your case requires more than one hearing, additional fees may be incurred.
  • Witness statements: If your case requires us to take statements from any witnesses then additional fees may be incurred.
  • Advice or assistance in relation to any appeal

Hourly Rates

Alternatively, for services charged on an hourly basis, our rates are as follows:

A Solicitors with 8+ years PQE, including 8+ years litigation experience £278.00
B Solicitors and Legal Executives with 4+ years PQE, including 4+ years litigation experience £233.00
C Other Solicitors, Legal Executives, and Fee Earners of Equivalent Experience £190.00
D Trainee Solicitors, Paralegals, and Other Fee Earners £134.00

Some trial matters will not be suitable for fixed fee arrangements and we will need to work on an hourly rates basis. We would need to assess your case before we are able to give a more accurate time and cost estimate. An indication of our hourly rates is set out below. The rates that apply will depend on who deals with your matter, the complexity of the case, time estimate and court location. Our fees would not be inclusive of travel, mileage or disbursements, which may include expert reports.

Before we charge you anything we will always first assess whether your case might qualify for free legal aid.

Timescales

In motoring offence cases, the length of the case is dictated by the court.

If you enter a Guilty plea and the case is dealt with in the Magistrates’ Court, the case will usually be dealt with in about six weeks.

The time occupied by Not Guilty plea cases varies so widely that it is not possible to estimate very accurately but a timetable will be set by the court at an early stage.
